WEST AFRICAN ECONOMIC AND MONETARY UNION (WAEMU) REGULATIONS

RELATING TO FOREIGN TRADE

 

The 1994 WAEMU Treaty defines the regulatory and institutional framework for trade in its member countries (see Article 4, Articles 76 to 87).

In addition to the 2002 customs tariff, different regulations and acts governing trade within the WAEMU are :

 

  Regarding regulations

-          Regulation No 05/2008/CM/UEMOA  (and its annex) amending the Annex to Regulation No 08/2007/CM/2007 of April 6, 2007, adopting the tariff and statistical nomenclature of the common external tariff (CET) of the UEMOA, based on the 2007 version of the Commodity Description and Coding System Harmonized System

-          Regulation No 08/2007/CM/UEMOA adopting the tariff and statistical nomenclature of the WAEMU CET, based on the version of the Commodity Description and Coding Harmonized System

-          Regulation No 07/2007/CM/UEMOA  relating to the safety of plants, animals and foods in UEMOA (link is external) 

-          Regulation No 17/2006/CM/UEMOA  (and its appendix) amending the appendix to Regulation No. 23/2002/CM/UEMOA 18 of  November 2002 on the amendment of the statistical and tariff nomenclature of the common external tariff (TEC) of the West African Economic and Monetary Union (WAEMU)

-          Regulation No02/97/CM/UEMOA  on the adoption of the WAEMU common external tariff

 

 In terms of acts and decisions

-          Instruction No 01/2007/CM/UEMOA camending Instruction No.°06/2001/CM/on harmonization of taxation of petroleum products within the WAEMU

-          Recommendation No 04/2004/CM/UEMOA   (link is external) relative to the negotiations of trade agreements and investment between WAEMU and third countries

-          Directive N°03/2002/CM/UEMOA  WAEMU (link is external) on the notification of regulation on the customs value of goods at the World Trade Organization (WTO)

-          Additional protocol No III  (link is external) establishing rules of origin of products of the WAEMU (December 2001)

-          Decision No.01/99/COM/UEMOA (link is external) regarding agreements of industrial products to benefit the Community Preferential Tax (TPC) equivalent to a 80% reduction of import duties applicable to the products of this kind imported from third countries, except where necessary, of specific or ad valorem taxes levied on domestic products of this kind, as they are locally produced or imported.

-          Additional act No. 04/98  (link is external) whose purpose is to institute for industrial products, a preferential community tax equivalent to a reduction of 60% of the import duties applicable to the products imported from third countries

-          Additional act No. 04/1996  (link is external) establishing a transitional preferential tariff arrangement for exchanges within the WAEMU .
